Personal information
You provide CMC Markets with your personal information when you ask for information about CMC Markets’ products and services, when you access and use this and other CMC Markets websites and/or when you submit an application for products and services provided by CMC Markets or to open an account with CMC Markets. You may also provide information to us when submitting other forms or documentation to CMC Markets for the purposes of changing the details registered to your account, executing transactions on an account, or otherwise. When assessing an application, CMC Markets may also collect information about you from publicly available sources such as company registers. CMC Markets may also collect personal information (which includes any relevant transaction data and account identifier data) from your financial services provider.
The types of personal information we may collect from time to time include, but is not limited to:
Identity information – such as your name, date of birth, nationality and identification details;
Contact details – such as your residential address, email address and telephone number;
Financial information – such as bank account details, source of funds, income and financial position;
Account and transaction information – including account balances, funding activity, trading history, positions, orders and margin activity;
Technical and usage information – such as IP addresses, device information, login data, platform usage and browsing behaviour;
Communications – including records of phone calls, emails, chats and other interactions with us; and
Compliance and verification information – including information required to verify your identity and assess fraud, risk and compliance with applicable laws.
If you give us personal information about another person, you represent that you are authorised to do so and agree to inform that person who we are, that we will use and disclose that information for the relevant purposes set out below and that they can access the information we hold about them.
CMC Markets maintains records of all transactions and activities on accounts you have with CMC Markets, including details of contracts traded and margin calls made. During the course of your relationship with CMC Markets, we will also gather information about products and services provided to you.
We are required by law to collect information to identify and verify you. CMC Markets may make enquiries as to your identity and other personal details as required by the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). Your personal information will be treated strictly in accordance with the Australian Privacy Principles in the Privacy Act 1988 (Cth) and the ‘private sector amendments’ contained in the Privacy Amendment (Enhancing Privacy Protection) Act 2012 (Cth).
We may also use your personal information to obtain a credit report from a credit-reporting agency. The report may contain personal credit information about you. We may also contact any credit provider named in the credit report, or any credit provider whose details have been provided to us by you, in order to obtain information relevant to opening your account or collecting overdue payments in relation to any trading activity.
Sensitive Information
Generally, we do not collect sensitive information about you unless required or permitted by law or where you consent for us to do so. In some circumstances, we may collect sensitive information with your consent or where you voluntarily provide it to us.
We may also collect biometric information for identity verification, account security and fraud prevention purposes.
We will handle any sensitive information in accordance with applicable privacy laws.
Sensitive information includes information relating to:
racial or ethnic origin
political opinions or religious beliefs
sexual orientation
criminal convictions
membership of professional or trade associations or unions
biometric or health information.
Telephone Conversations
CMC Markets may record telephone conversations between you and persons working for CMC Markets. Such recordings, or transcripts from such recordings, may be used to resolve any dispute between you and CMC Markets.
CMC Markets' Websites
We collect statistical information about visitors to our websites such as the number of visitors, pages viewed, types of transactions conducted, time online and documents downloaded. This information is used to evaluate and improve the performance of our websites. Other than statistical information, we do not collect any information about you through our websites unless you provide the information to us.
You should also be aware that we use cookies on our websites. A cookie is a small amount of data, which often includes a unique identification number or value that is sent to your browser from a website’s computer and stored on your computer’s hard drive. Each website can send its own cookies to your browser if your browser allows it. However, to protect your privacy, your browser only allows a website to access the cookies it has sent to your computer.
When cookies are used on our websites, they are used to collect the statistical information referred to above in addition to allowing you to access your account online. When you access your account online, a cookie will be created which uniquely identifies your computer and your username and password. This means that you do not have to re-enter those details each time you want to access your account online.
Most internet browsers are set up to accept cookies. If you do not wish to receive cookies, you may be able to change the settings of your browser to refuse all cookies or to have your computer notify you each time a cookie is sent to it and thereby give yourself the choice whether to accept it or not. If you reject all cookies, you will be unable to access your account online. You can also delete cookies from your computer after they have been created.

Use of the information by CMC Markets
The information requested in any application to open an account or other form or documentation completed by customers is required to enable us to provide a service to you or for the purpose described in or contemplated by the form or documentation completed by the customer. That information, together with the information collected and maintained by CMC Markets during the course of our relationship with you, is used to manage and administer the products and services provided to you. It is also used to keep you updated whilst you are a customer in relation to various matters including the contracts you have traded, your margin obligations, the funds in your account, and other activities of CMC Markets. In this Privacy Statement, ‘customer’ includes any representative of a customer or their estate.
We may also use your personal information, including market research, analysis and developing statistics across CMC Markets Group, to develop an understanding of the products and services that you may be interested in obtaining from CMC Markets and to market such products and services to you.
We may also use it to carry out marketing and send communications, including by email, post, text, digital communications, through our applications, newsletter, banner advertising and other forms of communication. We may analyse your personal information, as well as your trading activity, so that we can offer a more relevant, tailored service and product offering to you. Our advertisements may also reach you through social media and online platforms, tailored to your interests. By analysing your data, we may also create audiences, enabling us to connect with profiles similar to yours for more targeted advertising. If you opt out, you may still receive non-personalised ads from us.
CMC Markets may also disclose your personal information to:
financial institutions and other similar organisations that it deals with in the course of its corporate activities, including your financial services providers, or those that are nominated by you;
any organisation at your request or any persons acting on your behalf, including your financial adviser, broker, solicitor, accountant, or any person appointed by you to act as your agent;
credit reporting agency, any credit provider named in the report and any credit provider whose details have been provided to us by you;
regulatory and government bodies from time to time in Australia and other countries, or as otherwise required by law;
entities in the CMC Markets Group located in Australia or overseas where reasonably necessary to provide our products and services, including for operational, technology, compliance, client support and administrative purposes. The overseas recipients may be located in countries including the United Kingdom, Germany, Poland, Singapore and Canada, as well as other jurisdictions in which the CMC Markets Group operates from time to time; and
external service providers and professional advisers (which may be located overseas) that provide services to us.
Document Verification Service
In this Privacy Statement, ‘identification information’ has the meaning given to that term in section 6 of the Identity Verification Services Act 2023 (Cth) (IVS Act). Identification information is a type of personal information. Your rights and CMC Markets’ obligations set out in this Privacy Statement in respect of your personal information generally will also apply to any identification information that you disclose to CMC Markets in accordance with this section. CMC Markets’ collection and use of your identification information is also subject to obligations contained in the Document Verification Service (DVS) Participation Agreements between CMC Markets and The Commonwealth of Australia as represented by the Attorney-General’s Department.
CMC Markets uses the DVS to verify your identity documents. CMC Markets may disclose your identifying information to third party intermediary service providers when accessing the DVS. The Attorney-General’s Department will disclose your identification information to the government agencies that issued your identity documents to verify them in accordance with their records.

Please note that CMC Markets does not sell your personal information to third parties for marketing purposes.
Automated decisions
In certain circumstances, CMC Markets utilises computer programs that may use your personal information in their operations to make (or perform actions that are substantially and directly related to the making of) a decision which may affect your rights and interests.
Types of personal information used
These computer programs may use different kinds of personal information depending on the context, including:
identification information (such as your name, date of birth, and identification documents)
contact details
financial information (such as income, assets, and funding sources)
transaction and trading activity
account activity and behavioural information (such as platform usage and interaction patterns)
regulatory and verification information (such as sanctions screening results)
information derived from the above, such as risk scores, profiles, or eligibility assessments
Decisions made solely by computer programs
In some cases, decisions may be made solely by computer programs without human involvement. These may include:
automatically approving or declining account applications based on predefined eligibility criteria
identifying and blocking potentially fraudulent, suspicious, or unauthorised transactions or account activity
applying margin requirements, issuing margin calls, or automatically closing positions where account thresholds are met
restricting or suspending account access where risk or compliance triggers are identified
Decisions substantially influenced by computer programs
We also use automated systems to carry out processes that are substantially and directly related to decisions about you. This means the system plays a significant role in the decision, even where there is human involvement.
For example:
generating risk scores, client classifications, or appropriateness assessments that are used by our staff to determine access to products or services
identifying accounts or transactions for further review as part of fraud detection, anti-money laundering, or market surveillance processes
prioritising or filtering applications, transactions, or customer interactions for review
providing recommendations or insights that influence outcomes such as product access, account settings, pricing, or service offerings
What are your rights?
You need not give us any of the personal information (including identification information) requested by CMC Markets. However, without that information CMC Markets will not be able to open an account for you where the information is requested in an application form, or to provide you with any other services, information or assistance you have sought, or complete the requested action as contemplated by the relevant form or documentation you do not wish to fill out.
Access and Correction
You may request access to, or correction of, the personal information we hold about you. We will respond to access and correction requests within a reasonable period, and in most cases within 30 days. We may ask you to verify your identity before providing access or making a correction.
We will provide access in the form you request where reasonable and practicable. Access is generally free, although we may charge a reasonable fee where permitted by law and will inform you of any charges in advance. We do not charge for correction requests.
Please note, some of these rights only apply in certain circumstances and we may not be able to fulfil every request. We will take reasonable steps to destroy or de-identify your personal information where we no longer need your personal information for any purpose for which it may be used or disclosed under the Australian Privacy Principles or where we are not required under an Australian law, or a court/tribunal order, to retain your personal information. We may retain your personal information for the establishment, exercise or defence of legal claims.
How we protect your information
CMC Markets is committed to protecting the privacy of all personal information that CMC Markets obtains from you.
We continue to adopt industry and information security best practices to protect your personal information and ensure that unauthorised persons do not access it. Measures include encryption of data during transmission, strong authentication mechanisms, cybersecurity processes and secure access to machines and data.
We train our employees who handle personal information to respect the confidentiality of customer data and the privacy of individuals.
Do Not Call Register
We may contact you by telephone while you hold any product or receive any services from CMC Markets. If you do not want to be contacted by telephone about our products or services and not to disclose your information to others for that purpose, you must request this by calling +1300 660 262, for registration of your telephone number on our Do Not Call Register.
Receiving commercial electronic messages
With your consent, we may send marketing and/or promotional messages to any electronic address that you provide or for which you are responsible. You warrant that you have authority, either as or on behalf of the electronic account holder, to provide this consent and agree that until you withdraw your consent by providing written notice to us or using an unsubscribe facility in the message, we may continue to send commercial electronic messages to those addresses.
